Photo Sharing Terms

These Photo Sharing Terms (the "Photo Sharing Terms") govern your use of the photo sharing feature in partner chat within the Be More Kinky application ("BeMoreKinky", the "app", "we", "us", or "our"), operated by BeMore App LLC, a company licensed in Wyoming, USA. They form a separate and narrower agreement that supplements, and does not replace, our general Terms and Conditions. Before you send any photo through the app, you must affirmatively accept the current version of these Photo Sharing Terms by checking the box labelled "I agree to the Photo Sharing Terms." If any conflict arises between these Photo Sharing Terms and the general Terms and Conditions on the specific subject of photo sharing, these Photo Sharing Terms control. The photo sharing feature is intended only for intimate content shared between consenting adult partners, and your use of it is conditional on your agreement to everything set out below.

1. Encryption and access

1.1 Photos you share in partner chat are end-to-end encrypted. Encryption and decryption happen on the sending and receiving devices, using keys that we do not hold in a form that lets us read your content.
1.2 During normal use of the feature, our servers store only the encrypted photo (ciphertext). We cannot decrypt, view, open, or otherwise access the content of your photos in normal use.
1.3 Encryption protects the content of your photos. It does not encrypt all related information. To deliver messages, operate the service, and maintain security, we may still retain certain metadata associated with a photo, which may include sender and recipient identifiers, timestamps, message and photo identifiers, delivery status, and file size and file type. This metadata does not include the visual content of the photo.
1.4 We retain the ciphertext of a shared photo only for as long as is reasonably necessary to deliver it and to operate the feature. Once a photo is delivered and is no longer required for delivery, the stored ciphertext is removed in the ordinary course of operation. Retention of metadata is described in our Privacy Policy.
1.5 You understand and accept that a decrypted (viewable) copy of a photo may exist on a device outside our control. In particular, a photo that has been opened may be stored locally on the recipient's own device, and may be included in that user's own device backups or personal cloud backups. These local and backup copies are outside BeMoreKinky's systems and outside our control, and they are not governed by the end-to-end encryption described above. You are responsible for the security of your own devices and backups.

2. Reporting and moderation

2.1 Either party to a chat may report a photo. You may report a photo you received, and you may report a photo you sent. Reporting is the mechanism by which content is brought to our attention for review.
2.2 Reporting breaks the encryption seal, by design, and this is the only way we obtain a viewable copy of a photo. When you report a photo, your own device decrypts that photo and uploads a decrypted (plaintext) copy of it to BeMoreKinky for moderation review. Along with the decrypted copy, we receive related context and metadata reasonably necessary to assess the report (for example, the identifiers of the sender and recipient, timestamps, and the reason for the report). We do not receive a decrypted copy of any photo unless and until it is reported.
2.3 Reported photos are reviewed by trained moderation staff who are bound by confidentiality obligations. Review is carried out for the purpose of enforcing these Photo Sharing Terms, our Community Guidelines, and applicable law.
2.4 Where a report is substantiated, we may take one or more of the following actions, in our reasonable discretion and proportionate to the violation: issue a warning, remove content, suspend or terminate the account or accounts involved, and refer the matter to law enforcement or other competent authorities.
2.5 We retain the decrypted copy of a reported photo and the associated moderation records for 12 months from the date of the report, after which they are deleted. The exception is content that is subject to a legal hold or that must be preserved for longer by law (for example, suspected child sexual abuse material preserved as evidence, reports made to the National Center for Missing & Exploited Children (NCMEC), or law enforcement preservation requests), in which case it is retained for as long as the law requires.
2.6 Operating a reporting and moderation process does not mean we monitor, screen, or scan the content of private encrypted messages or photos, and we are under no obligation to do so. We act on reports and on actual knowledge of apparent violations. We have the right, but not the obligation, to review content that is reported to us and to remove content or restrict accounts at our discretion.

3. User control and consent

3.1 Received photos are not displayed automatically. You control when a received photo is opened, and a photo is decrypted for viewing on your device only when you choose to open it.
3.2 You must only open and share photos within a consenting adult context. By sending or opening a photo, you confirm that all individuals depicted are consenting adults and that the exchange is consensual.
3.3 End-to-end encryption, and the fact that received photos are not displayed automatically, cannot prevent a recipient from taking a screenshot, making a screen recording, photographing the screen with another device, or otherwise capturing or re-sharing a photo you send, and we may not be able to detect when this happens. You should only share photos with partners you trust.

4. Content you are responsible for

4.1 You may only share photos that you have the right and consent to create, possess, and send. This includes the consent of every person depicted in the photo.
4.2 You are solely responsible for the photos you send. You must not share any content that is prohibited under our Community Guidelines, and the prohibited content categories set out there apply in full to photos shared through this feature.
4.3 Both sending and receiving photos through this feature require the consent of everyone involved, including the recipient's consent to receive them. You must not forward, re-share, publish, or show to anyone else a photo you received without the consent of every person depicted in it.

5. Zero-tolerance prohibited content

5.1 The following content is strictly and absolutely prohibited, with no exception: any content involving minors, including child sexual abuse material (CSAM); non-consensual intimate images (NCII), including images that are digitally created, AI-generated, deepfaked, or otherwise altered to depict a real person, and including images captured covertly (for example upskirt images or so-called creepshots), and including the sharing of, threatening to share, or soliciting of such images; and any content involving coercion, exploitation, harassment, or abuse.
5.2 Content of the kinds listed in clause 5.1 may be reported to authorities. This includes reporting to NCMEC and to law enforcement or other competent authorities, and any other reporting or preservation required by law.
5.3 There is no legitimate use of this feature for prohibited content, and accepting these Photo Sharing Terms does not grant you any right or tolerance to share it.

6. Age and eligibility

6.1 You must be at least 18 years old, or the age of majority in your jurisdiction if that is higher, to use the photo sharing feature.
6.2 By accepting these Photo Sharing Terms and using the feature, you represent and warrant that you meet the age and eligibility requirements in clause 6.1 and that every person depicted in any photo you share is likewise an adult.

7. Consequences of violation

7.1 If you violate these Photo Sharing Terms, we may take any of the enforcement actions described in clause 2.4, including warning, content removal, and suspension or termination of your account, in our reasonable discretion.
7.2 Where required or permitted by law, we may refer violations to law enforcement or other competent authorities and may preserve and disclose relevant content and records in connection with such a referral.
7.3 Suspension or termination of your account for a violation does not entitle you to any refund of fees you have paid, and no fees will be refunded in such circumstances.
7.4 The enforcement actions in these Photo Sharing Terms are in addition to, and do not limit, any rights or remedies available to us under the general Terms and Conditions or applicable law.

8. Versioning and re-acceptance

8.1 We may update these Photo Sharing Terms from time to time. Each version carries a version number, and the current version is shown at the top of this document.
8.2 The app operates a versioned re-consent gate. You must affirmatively accept the current version of these Photo Sharing Terms before you can send photos, and the app records which version you accepted and when.
8.3 If we make a material update to these Photo Sharing Terms, you will be required to accept the updated version before you can continue to use the photo sharing feature. Continued use of the feature after a material update requires re-acceptance of the current version.

9. Jurisdiction, governing law, and contact

9.1 These Photo Sharing Terms are governed by the laws of the jurisdiction in which BeMore App LLC is incorporated, namely Wyoming, USA, without regard to its conflict of law principles, consistent with our general Terms and Conditions.
9.2 Any dispute arising out of or relating to these Photo Sharing Terms or the photo sharing feature will be resolved by binding arbitration, except where binding arbitration is prohibited or otherwise required to be handled differently by applicable law. This dispute resolution provision is consistent with, and to be read together with, our general Terms and Conditions.
9.3 Our handling of personal information in connection with the photo sharing feature is described in our Privacy Policy.

10. Non-consensual intimate image reports and removal

10.1 If you are depicted in an intimate image that was shared through the app without your consent, you, or someone authorized to act on your behalf, may request its removal by contacting us at support@bemorekinky.com. You do not need to be a registered user to make a request.
10.2 To help us act quickly, a request should include: (1) your physical or electronic signature; (2) identification of you as the person depicted, or of your authority to act for that person; (3) a statement that the image was shared without your consent; (4) information reasonably sufficient to help us locate the image; and (5) your contact information.
10.3 We will remove image content covered by a valid request as soon as possible and, in any event, within 48 hours of receiving it, and we will make reasonable efforts to identify and remove any known identical copies. If you are an adult, you may also use StopNCII.org to help prevent your intimate images from being shared on participating platforms. If an intimate image of you was taken when you were under 18, you may use the National Center for Missing & Exploited Children (NCMEC) Take It Down service at takeitdown.ncmec.org.
