This Privacy Policy describes how BeMore App LLC (the “Company,” “we,” “our,” or “us”), a company licensed in Wyoming, collects, uses, discloses, and safeguards your personal information when you use the Be More Kinky mobile application (“Service”). By accessing or using the Service, you agree to the collection and use of information in accordance with this policy. If you do not agree with our practices, please do not use our Service.
1. Information We Collect
1.1 Personal Information
We may collect personal information that can be used to identify you, such as your name, email address, age verification status, and other details you provide when registering for an account or interacting with the Service.
1.2 Usage Data
We automatically collect certain information about how you access and use the Service, including device information (e.g., unique device identifiers), IP address, browser type, operating system, app version, and usage statistics such as the pages or features you visit, the frequency and duration of your visits, and the time spent on the Service.
1.3 Cookies and Similar Technologies
We may use cookies, web beacons, and similar technologies to enhance your experience, gather general visitor information, and track usage of our Service. You can instruct your browser or device to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly without cookies.
1.4 Partner Invitations and Communications
If you choose to invite a partner or contact through our Service, we may collect their email address or other contact details to send the invitation or facilitate communication. You warrant that you have the recipient’s consent to provide their contact information.
1.5 Encrypted Photos and Reported Photo Content
Our partner chat offers end-to-end encrypted photo sharing, as described in our Photo Sharing Terms. During normal use, photos shared in partner chat are end-to-end encrypted, and our servers store only the encrypted data (ciphertext) and cannot view the photo content. When you report a photo (whether one you received or one you sent), your own device decrypts that photo and uploads a decrypted (plaintext) copy to us for moderation review. This reporting process is the only way we obtain a viewable copy of a shared photo. We collect and retain these decrypted copies of reported photos together with associated moderation records, such as the report reason, the reporting and reported user identifiers, and the outcome of our review.
1.6 Chat Photo Metadata
Even when photo content is end-to-end encrypted and not viewable by us, we collect and retain certain related metadata, including sender and recipient identifiers, timestamps, message and photo identifiers, delivery status, and the file size and type of the photo.
2. How We Use Your Information
2.1 To Provide and Maintain the Service
We use your information to create and manage your account, deliver personalized content, facilitate matchmaking or partner invitations, process transactions, provide customer support, and maintain the functionality of the Service.
2.2 To Personalize User Experience
We may analyze usage data to understand user preferences and improve the Service. This enables us to offer more relevant content, recommended features, and better overall user experiences.
2.3 To Communicate with You
We may use your contact information to send service-related emails, technical notifications, marketing materials, newsletters, or other announcements. You can opt out of certain communications at any time by following the unsubscribe instructions provided or by contacting us directly.
2.4 For Security and Fraud Prevention
We use the information we collect to protect against, investigate, and deter fraudulent or unauthorized activity on the Service, and to ensure the security of our systems, networks, and users.
2.5 To Comply with Legal Obligations
We may process or disclose your information to comply with governmental regulations, legal obligations, or court orders, or to respond to lawful requests by public authorities.
2.6 Content Moderation, Safety, and Metadata
We use decrypted copies of reported photos and associated moderation records to review reported content, enforce our terms, protect users, and prevent, detect, and address illegal activity and other harms. We use chat photo metadata to deliver messages, operate and maintain the Service, and preserve the security and integrity of our systems. Where the EU or UK General Data Protection Regulation applies, we process the content of reported photos only on the basis of your explicit consent (Article 9(2)(a)), in addition to a lawful basis under Article 6. We rely on our legitimate interests in safety, content moderation, and the prevention of illegal activity for retained metadata and non-content safety signals, and on our compliance with legal obligations for mandatory reporting and preservation.
3. Disclosure of Your Information
3.1 Service Providers
We may share your information with trusted third-party service providers who perform functions on our behalf, such as hosting, payment processing, analytics, or email delivery. These entities are contractually obligated to protect your information.
3.2 Business Transactions
In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of such a transaction. Any acquiring entity or merged entity will continue to protect your information according to this Privacy Policy.
3.3 Legal Compliance
We may disclose your information if required to do so by law or in good faith belief that such action is necessary to comply with legal obligations, protect and defend our rights or property, prevent or investigate potential wrongdoing, or protect the personal safety of users or the public.
3.4 Consent
We may disclose your information for any other purpose with your explicit consent.
3.5 Reporting to Authorities and NCMEC
In addition to the legal compliance disclosures described in section 3.3, where legally required we may report and disclose reported photo content and associated records to law enforcement, the National Center for Missing & Exploited Children (NCMEC), and other competent authorities. This includes suspected child sexual abuse material (CSAM), non-consensual intimate imagery (NCII), and similar illegal or harmful content.
3.6 Sub-Processors for Moderation
We may engage service providers (sub-processors) to host and process decrypted reported photo content and moderation data for the purposes of moderation review and storage. These sub-processors are bound by contractual confidentiality and data-protection obligations.
4. Data Retention
We retain your personal information only for as long as is necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. When we no longer need your personal information, we securely dispose of it according to our data retention and deletion policies.
4.1 Reported Photo Content
We retain decrypted copies of reported photos and their associated moderation records for 12 months from the date of the report, consistent with our preservation obligations under United States law (18 U.S.C. § 2258A(h)). Reported copies are stored securely, with access limited to moderation and legal personnel. Content that is suspected child sexual abuse material is preserved and reported to the National Center for Missing & Exploited Children (NCMEC) as required by law, rather than deleted at the end of the standard retention period. We may also retain content longer where it is subject to a legal hold or must be preserved longer by law.
5. Security Measures
We employ a variety of security measures, including encryption and secure hosting, to help protect your personal information from unauthorized access, alteration, disclosure, or destruction. However, no security system is impenetrable. We cannot guarantee the absolute security of our systems or databases, nor can we guarantee that the information you provide will not be intercepted while being transmitted to us.
6. International Data Transfers
If you are accessing the Service from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries where our servers or third-party service providers are located. By using the Service, you consent to the transfer of your information to the U.S. or any other country in which BeMore App LLC or its service providers maintain facilities.
7. Children’s Privacy
The Service is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If you are aware of someone under the age of 18 using our Service, please contact us so we can take immediate action to remove any associated data.
8. Your Rights and Choices
8.1 Access, Update, and Delete
You may access, update, or delete certain personal information via your account settings. If you wish to request deletion of your account and associated data, please contact us at the email address provided below. We will make every effort to comply with your request in accordance with applicable laws.
8.2 Opt-Out of Communications
You can opt out of marketing emails by following the unsubscribe link included in our communications. However, you may still receive administrative or transactional messages from us, such as service updates or account notifications.
8.3 Do Not Track
Our Service does not respond to Do Not Track signals. If you wish to limit certain tracking, you can adjust your browser or device settings to block or alert you about cookies.
8.4 Special Category and Sensitive Data
Photos shared through the photo sharing feature, and information about your sex life or sexual orientation, are ‘special category’ personal data under the EU and UK GDPR (Article 9) and ‘sensitive personal information’ under California law. Where the GDPR applies, we process this data only with your explicit consent or where another Article 9 condition applies, such as the establishment, exercise, or defense of legal claims or reasons of substantial public interest for safety and the prevention of illegal activity. Where California law applies, we use sensitive personal information only for purposes permitted by law, including providing the Service and protecting safety, and you may have the right to limit its use. You can withdraw your consent or make a request by contacting us at the address in section 11.
9. Third-Party Links and Services
The Service may contain links to third-party websites, plug-ins, or applications that are not operated by us. We do not control these third parties and are not responsible for their privacy practices or content. We encourage you to review the privacy policies of any site or service you interact with.
